Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) forms part of the Terms of Service for the mallow wallet mobile application (the “App”) and wallet.mallow.art (the “Site,” and together, the “Services”). By using the Services, you agree to the AUP. If you do not agree, do not use the Services.

1. Compliance with law

You must use the Services only in compliance with all applicable laws, including:

  • Anti-money-laundering (AML), counter-terrorist-financing (CTF), and sanctions laws (including OFAC sanctions and equivalent laws in your jurisdiction)
  • Tax reporting obligations applicable to your activity
  • Securities, commodities, and consumer-protection laws applicable to any tokens or services you interact with through the App
  • Export-control laws applicable to the App software

You may not use the Services to facilitate illegal activity or to interact with assets, addresses, or counterparties that you know or reasonably should know are subject to sanctions or are derived from criminal conduct.

2. Prohibited conduct

You must not, and must not allow any third party to:

  • Use the Services to fund, facilitate, or conceal terrorism, sanctions evasion, money laundering, fraud, market manipulation, theft, or any other illegal activity
  • Send funds to addresses associated with sanctioned persons, sanctioned jurisdictions, or known illicit activity
  • Attempt to gain unauthorized access to other users’ wallets, devices, or accounts, or to any backend system operated by mallow or its providers
  • Interfere with, disrupt, or impose an unreasonable load on the App, the Site, or any service they rely on (including api.mallow.art, pin.mallow.art, our RPC providers, or third-party APIs)
  • Probe, scan, test, or attempt to circumvent any security or rate-limiting measure
  • Use any robot, spider, scraper, or other automated means to access the Site or our APIs except for documented public endpoints used in accordance with their stated rate limits
  • Reverse-engineer, decompile, or otherwise attempt to derive the App’s source code or proprietary algorithms, except to the extent applicable law permits notwithstanding this restriction
  • Repackage, re-distribute, host, mirror, or rebrand the App or Site without our prior written consent
  • Modify the App, distribute modified versions, or create unauthorized forks that present themselves as mallow products
  • Use the App as part of a product that competes with mallow without our prior written consent
  • Phish, impersonate mallow, or use a domain, name, branding, or imagery that is confusingly similar to mallow
  • Submit false reports, spam our support channels, or harass our team

3. Content you submit

If you submit content through the Services (e.g., support messages, metadata you mint via IPFS, or feedback), you warrant that the content:

  • Is yours or you have all necessary rights and permissions
  • Does not infringe any intellectual-property right, privacy right, or contractual obligation
  • Is not unlawful, defamatory, obscene, hateful, harassing, threatening, or otherwise objectionable
  • Does not contain malware, exploit code, or content designed to harm systems or users

We may, at our discretion and without obligation, review, refuse, or remove submitted content that we believe violates this AUP or the law.

4. Reporting abuse

If you believe content or conduct on the Services violates this AUP, please notify us at legal@mallow.art. To report a suspected security vulnerability, please use security@mallow.art.

5. Consequences

If we determine, in our reasonable judgment, that you have violated this AUP, we may, in addition to any rights under the Terms of Service:

  • Issue a warning
  • Remove or refuse offending content
  • Restrict your access to specific features
  • Suspend or terminate your access to the Services
  • Notify and cooperate with law enforcement or applicable regulators

We exclude liability to the maximum extent permitted by law for actions we take in response to a violation.
