Acceptable Use Policy

This Acceptable Use Policy (the "AUP") forms part of the Terms of Service for the mallow wallet mobile application (the "App") and wallet.mallow.art (the "Site," and together, the "Services"). By using the Services, you agree to the AUP. If you do not agree, do not use the Services.
1. Compliance with law
You must use the Services only in compliance with all applicable laws, including:
- Anti-money-laundering (AML), counter-terrorist-financing (CTF), and sanctions laws (including OFAC sanctions and equivalent laws in your jurisdiction)
- Tax reporting obligations applicable to your activity
- Securities, commodities, and consumer-protection laws applicable to any tokens or services you interact with through the App
- Export-control laws applicable to the App software
You may not use the Services to facilitate illegal activity or to interact with assets, addresses, or counterparties that you know or reasonably should know are subject to sanctions or are derived from criminal conduct.
2. Prohibited conduct
You must not, and must not allow any third party to:
- Use the Services to fund, facilitate, or conceal terrorism, sanctions evasion, money laundering, fraud, market manipulation, theft, or any other illegal activity
- Send funds to addresses associated with sanctioned persons, sanctioned jurisdictions, or known illicit activity
- Attempt to gain unauthorized access to other users' wallets, devices, or accounts, or to any backend system operated by mallow or its providers
- Interfere with, disrupt, or impose an unreasonable load on the App, the Site, or any service they rely on, including mallow's own servers and the blockchain and storage providers we depend on
- Probe, scan, test, or attempt to circumvent any security or rate-limiting measure
- Use any robot, spider, scraper, or other automated means to access the Site or our services, except where we publicly document an interface for that purpose and you stay within its stated limits
- Reverse-engineer, decompile, or otherwise attempt to derive the App's source code or proprietary algorithms, except to the extent applicable law permits notwithstanding this restriction
- Repackage, re-distribute, host, mirror, or rebrand the App or Site without our prior written consent
- Modify the App, distribute modified versions, or create unauthorized forks that present themselves as mallow products
- Use the App as part of a product that competes with mallow without our prior written consent
- Phish, impersonate mallow, or use a domain, name, branding, or imagery that is confusingly similar to mallow
- Submit false reports, spam our support channels, or harass our team
3. Content you submit
This section covers everything you publish through the Services: your profile (username, display name, bio, avatar and banner images, social links), curations you assemble, artworks and metadata you mint, notes you attach to a report, and messages you send us.
You warrant that the content:
- Is yours or you have all necessary rights and permissions
- Does not infringe any intellectual-property right, privacy right, or contractual obligation
- Is not unlawful, defamatory, obscene, hateful, harassing, threatening, or otherwise objectionable
- Does not contain malware, exploit code, or content designed to harm systems or users
Note what minting means. Artwork images and metadata you mint are published to a public blockchain and pinned to IPFS. That is permanent and irreversible. We can remove an artwork from mallow's own surfaces; we cannot delete it from the blockchain or from IPFS, and neither can you. Do not mint anything you may later need to retract.
We may, at our discretion and without obligation, review, refuse, or remove submitted content that we believe violates this AUP or the law.
4. Objectionable content and abusive users
We have zero tolerance for objectionable content and abusive behaviour on the Services. In addition to the prohibitions in Section 2, you must not publish, mint, or transmit content that:
- Sexualises minors in any way, or depicts child sexual abuse
- Is pornographic or sexually explicit
- Depicts or glorifies gratuitous violence, self-harm, or cruelty
- Promotes terrorism, violent extremism, or a hate group
- Harasses, bullies, threatens, doxxes, or incites violence against any person or group
- Attacks or demeans people on the basis of race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender, gender identity, disability, or serious disease
- Impersonates another person, artist, or brand, or misrepresents the provenance or authorship of an artwork
- Advertises fraud, scams, phishing, or deceptive token or NFT schemes
We remove content that violates this section and we remove the accounts of users who post it.
5. Reporting, blocking, and how we respond
Reporting. Every artwork, curation, and account in the App has a Report option in its ⋯ menu. Choose the reason that fits and add a note if it helps. Reports are reviewed by mallow.
Blocking. You can Block any account from its profile or from the same ⋯ menu. Blocking hides that account and its content from your view, immediately and for as long as the block stands. You can review and undo your blocks at Settings → Security & Privacy → Blocked accounts.
Our response. We review reports of objectionable content and abusive users and act on them within 24 hours — by removing the content, suspending or removing the account responsible, or both. Content you have reported is hidden from your own view straight away, before we have finished reviewing it.

6. Consequences
If we determine, in our reasonable judgment, that you have violated this AUP, we may, in addition to any rights under the Terms of Service:
- Issue a warning
- Remove or refuse offending content
- Remove or hide an artwork, curation, or profile from mallow's surfaces
- Delist an artwork from the mallow marketplace
- Restrict your access to specific features
- Suspend or delete your mallow profile
- Suspend or terminate your access to the Services
- Notify and cooperate with law enforcement or applicable regulators
We exclude liability to the maximum extent permitted by law for actions we take in response to a violation.
